Welcome to CalmPathMarket ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at calmpathmarket.sbs (the "Service") operated by CalmPathMarket.
By confirming a charter or utilizing our Service, you consent to abide by these Terms. If you do not accept any portion of these terms, you are prohibited from using the Service.
2. Service Overview
CalmPathMarket offers luxurious yacht charter services, which include, but are not limited to:
- Yacht rentals for a day
- Evening sea voyages
- Company outings
- Exclusive gatherings
- Extended yacht journeys
Our provisions are subject to change and depend on weather conditions. We maintain the right to adjust or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
The steps to reserve a yacht include:
- Being 18 years or older
- Submitting accurate and up-to-date information
- Transferring the necessary deposit outlined in your reservation confirmation
- Agreeing to these Terms & Conditions
3.2 Confirmation
Your reservation is only secured following payment and our issuance of written confirmation. Service denial remains within our judgment.
3.3 Availability
Chartering is contingent on boat availability and favorable weather. We strive to honor your preferred schedule.
4. Payment Terms
4.1 Pricing
Costs are presented in € and incorporate all relevant taxes unless stated differently. Prices may alter without prior notice.
4.2 Payment Schedule
- Deposit: Half of the total charge for the charter is due upon reservation
- Remaining payment: Owed 48 hours prior to the time of departure
- Extra costs (if applicable): Due once the charter concludes
4.3 Payment Methods
We honor most major credit cards, direct bank transactions, and certified cheques. Our secure, encrypted infrastructure manages payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- In excess of 72 hours before departure: Complete refund excluding transaction fees
- Between 24 to 72 hours prior to departure: Half refund
- Under 24 hours to departure: No refund possible
5.2 Weather Cancellations
In the scenario where the captain deems weather conditions unsafe, we shall propose to:
- Postpone your charter to an alternative date at no extra cost
- Issue a full refund when rescheduling isn't feasible
5.3 Mechanical Issues
If mechanical issues arise with the allotted vessel, our goal is to provide an equivalent replacement. If that is not feasible, a complete refund will be furnished.
6. Safety and Conduct
6.1 Safety Requirements
Guests on board must:
- Heed all guidance from the crew
- Utilize required safety gear when instructed
- Disclose any health conditions that may influence their safety
- Stay within specified areas on the vessel
6.2 Prohibited Items
Prohibited items include, but are not limited to:
- Glassware
- Illicit substances
- Guns or other weapons
- Excess consumption items
- Undeclared animals (unless prior clearance has been given)
6.3 Conduct
Guest behavior must be respectful. We retain the right to end a charter prematurely without refund if a passenger's actions are hazardous or interrupt the experience of others.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped at your charter fees. We are not answerable for:
- Injuries sustained from your neglect
- Theft or damage of your belongings
- Indirect or punitive damages
- Delays caused by weather or factors outside our influence
7.2 Insurance Coverage
We carry full marine insurance for our fleet and operations. Clients are advised to procure their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our charter services, you understand that maritime activities carry inherent risks and you accept responsibility for your own safety.
8. Modifications and Itinerary Changes
We have discretion to alter itineraries, pathways, or timetables due to climatic conditions, safety concerns or operational needs. We'll endeavor to ensure alternative experiences of a comparable nature.
9. Force Majeure
Circumstances beyond our command, such as but not restricted to:
- Intense meteorological conditions
- Catastrophic events
- Regulatory mandates
- Halt of harbor operations
- Technical failures
We cannot be held culpable for hindrances, cancellations, or changes resulting from these situations.
10. Privacy and Data Protection
Your private data is managed in accordance with our Privacy Policy. Service engagement implies consent to the accumulation and usage of your data as denoted in our Privacy Policy.
11. Intellectual Property
Our website's material, encompassing text, graphics, logos, and photos, is safeguarded by copyright and trademark statutes. You are barred from replicating, disseminating, or generating derivative compositions without our explicit agreement.
12. Governing Law
These Terms are under the jurisdiction of the laws in Germany. Any legal disputes will be settled in courts located in Hamburg, Germany.
13. Changes to Terms
We reserve the authority to adjust these Terms as needed. Amendments will be communicated on our site with an indicated revision date. Continual service utilization signifies accord with amended stipulations.
